*****The following cases are examples of some of my wins. The cases that read DISMISSED are real Dismissals, not Continued Without a Finding cases that stay on your record forever and count as a first offense for THE REST OF YOUR LIFE. These case also include multiple offenses up to FIFTH offenses!!! Cases that were charged as third offenses or more (felonies) but were reduced to misdemeanors with NO JAIL TIME are not listed but are considered WINS. December 2008Brockton District Court - The police responded to a report of a car driving on a lawn, hitting a tree and fleeing from the scene. They responded to the location and found the client outside of her car and visibly intoxicated. She was argumentative and uncooperative and failed all of the field sobriety tests. - NOT GUILTY November 2008Peabody District Court - The client was stopped for crossing into oncoming traffic. She produced her license and registration without a problem. She did not complete the one leg stand or walk and turn test. - NOT GUILTY Cambridge District Court - a police officer noticed damage to a light pole and found the client behind the wheel of a damaged vehicle one block away. His had difficulty waking the client up and when he awoke he had very slurred speech and was placed under arrest. - NOT GUILTY Peabody District Court - The client was stopped after a cell phone caller called the police reporting that he was following a vehicle that was all over the road. The officer then pulled the car over for speeding. The client produced his license without difficulty, admitted drinking and was told to get out of the car. The client could not stand on one leg for more than 3 seconds and could not walk heel to toe. His recitation of the alphabet was not understandable according to the officer and repeatedly asked to be let go. - NOT GUILTY October 2008Federal District Court - The client was stopped for running a stop sign. He was cooperative with the officer. He failed the alphabet, one leg stand and the 9 step walk and turn test. .079% breath test - CASE DISMISSED Hingham District Court- The police responded to a call about a hit and run. They went to the owner of the vehicles home and spoke to the client who admitted being in an accident. The officer wrote in his report that the client was slurring his words, smelled of alcohol, had glassy eyes and was unsteady on his feet. The client failed all of the field sobriety tests. - CASE DISMISSED September 2008Federal District Court - The client was stopped for running a stop sign. She was cooperative with the officer. She produced her license and registration without a problem. She stumbled at the back of the car but otherwise was not unsteady. She did not complete the one leg stand, walk and turn and horizontal gaze nystagmus to the officer's satisfaction, but was able to do a finger to nose test. .13% breath test - NOT GUILTY Newton District Court - The client was involved in a one car rollover accident. The police responded and observed that the client had an odor of alcohol and bloodshot eyes. The client was transported to the hospital and his blood alcohol level was .13% -NOT GUILTY August 2008Hingham District Court -The police officer observed a vehicle cross the fog line twice and almost hit a parked car. The driver was slow to react to the officer's requests. The officer detected and odor of alcohol, slurred speech and bloodshot eyes. The officer testified the client was having a difficult time understanding the field test instructions and could not say the alphabet. - NOT GUILTY QUINCY DISTRICT COURT - The police observed the client's motor vehicle stopped in the middle of the road. Witnesses said the client was swerving and then just stopped. The officer approached and noted that the window and noted an odor of alcohol coming from the vehicle. The officer noted that the client's eyes were bloodshot and glassy and her speech was slurred. The client stated in a slurred manner that he was going for cigarettes. The client was placed under arrest admitted to taking a number of pills and had a breath test reading of .05% - NOT GUILTY Stoughton District Court - The officer testified that he approached the client's car because he was blocking an emergency vehicle. He also testified that the client had slurred speech, bloodshot eyes, unsteady on his feet and that there was an odor of an alcoholic beverage on his breath. - NOT GUILTY Attleboro District Court - the officer responded to a motor vehicle accident involving a car and a tree on someone's lawn. The officer observed an odor of alcohol. According to the officer the defendant was uncooperative and swore at the officer. The officer wrote that she failed the alphabet test, the one-legged stand, the finger to nose test and the nine-step walk and turn. - DISMISSED Dorchester District Court A caller reported that the defendant was operating erratically on Route 93. The State trooper followed the defendant for a period of time and noticed a number of marked lanes violations. The defendant was pulled over by the state trooper at which time the trooper noted an odor of alcohol, slurred speech and red and glassy eyes. According to the trooper the defendant failed the walk and turn test.- DISMISSED July 2008QUINCY DISTRICT COURT - at approximately 2:50 a.m. the police observed the client's motor vehicle stopped in the middle of intersection. The officer approached and noted that the window to the driver side door was already down. He noted an odor of alcohol coming from the vehicle. The officer noted that the client's eyes were bloodshot and glassy and her speech was slurred. The client took five minutes to locate her license. The client stated in a slurred manner that she was coming from a bar in Boston and was heading home to Weymouth. The client bumped into the side of the car as she walked. The client failed the field sobriety tests and was placed under arrest. During the tests the back-up officer noted that the client's front tire was shredded. The client became unruly when she got back to the police station. - NOT GUILTY Barnstable District Court - The officer saw the client going on the wrong side of a traffic island. The officer pulled him over and approached the car. He noted that the client appeared unsteady. He also noted that the defendant's speech was slurred, he had red watery eyes and there was an odor of alcohol coming from his person. The defendant passed the one-legged stand and failed the nine step walk and turn. The client took the breath test with a result of .10 - DISMISSED June 2008Concord District Court - A caller reported that the defendant was operating erratically. The defendant was found by the officer in his car, in his parking place in a condo complex. The officer noted an odor of alcohol and slurred speech. According to the officer the defendant failed the one legged stand test and the walk and turn test but he told the officer he had recent knee surgery.- NOT GUILTY May 2008Hingham District Court - the client was seen traveling through a red light on a main street. The officer stopped the client and noticed a strong odor of alcohol, red glassy eyes and slurred speech. The client admitted to drinking 4-5 beers at his friend's house. According to the officer the client failed the alphabet, the count backwards, the 9 step walk and turn and the one legged stand. The client took the breath test with a result of .12 - NOT GUILTY Hingham District Court - The officer saw the client going over the marked lines. The officer pulled him over and approached the car. He noted that the client appeared unsteady. He also noted that the defendant had extremely bloodshot eyes, slurred speech and there was an odor of alcohol coming from his person. The defendant passed alphabet test and failed the one leg stand and the nine step walk and turn. - The client took the breath test with a result of .14 - DISMISSED Wareham District Court - the client was seen lying down in the driver's seat of a running motor vehicle. The officer testified that the client had slurred speech and was unable to stand on his own. There was an odor of an alcoholic beverage emanating from his breath. The client was then placed in handcuffs and became resistant. The officer found marijuana in the client's motor vehicle. - NOT GUILTY Dedham District Court - The client was involved in a single car accident on route 24. The client told the troopers that he was at a gentleman's establishment from 8:00 p.m. to midnight and drank five or six Coors lights. The client elected to take the breath test and the results were a .21 . A Civilian witness stated that he was struck by the client's vehicle which he estimated was traveling in excess of 90 mph. - NOT GUILTY New Bedford District Court The officer saw the client going over the marked lines. The officer pulled him over and approached the car. He noted that the client appeared unsteady. He also noted that the defendant had bloodshot eyes, slurred speech and there was an odor of alcohol coming from his person. The defendant failed the alphabet test, a counting backwards test, the one leg stand and the nine step walk and turn. - NOT GUILTY April 2008Milford District Court - A caller reported that the defendant was operating erratically on Route 495. The State trooper followed the defendant for a period of time and noticed a number of marked lanes violations. The defendant was pulled over by the state trooper at which time the trooper noted an odor of alcohol, slurred speech. The defendant told the trooper that he was coming from a concert and indicated that he had drank some beers before the show. According to the trooper the defendant failed the HGN test, the one legged stand test and the walk and turn test.- NOT GUILTY Plymouth District Court - the officer saw the defendant driving in a closed mall parking lot at approximately 2:24 a.m. The officer stopped the defendant and observed slurred speech, an odor of alcohol coming from the defendant and an open case of bud light bottles in the car. According to the officer the defendant failed the one-legged stand test and the nine step walk and turn test. - NOT GUILTY Plymouth District Court - the officer responded to a motor vehicle accident involving a car and a building at about 2:04 am. The defendant was wearing sunglasses when he spoke to the officer and told the officer that he didn't realize he had them on. The officer observed an odor of alcohol, slurred speech and blood shot eyes. The defendant stated that he was driving too fast and went off the road and that he had five or six beers in Abington. According to the officer the defendant failed the alphabet test, the one-legged stand, the finger to nose test and the nine-step walk and turn. The defendant took a breath test and blew a .17 .- NOT GUILTY Brockton District Court - The officer saw the client going over the marked lines. The officer pulled her over and approached the car. He noted that the client appeared unsteady. He also noted that the defendant had red watery eyes and there was an odor of alcohol coming from her person. The defendant passed the alphabet test and failed a counting backwards test, the one leg stand and the nine step walk and turn. The client took the breath test with a result of .11 - NOT GUILTY March 2008Quincy District Court - The trooper responded to an accident on Route 93. The trooper found the client outside the car eating breath mints. He noted an odor of alcohol and the client told the trooper he had knee problems. The defendant failed the alphabet test, nine-step walk and turn and the one-legged stand. - NOT GUILTY Quincy District Court - The trooper observed the defendant swerving on Route 93. The trooper stopped the defendant and observed him drive up onto the curb and then back down onto the roadway. The trooper noted an odor of alcohol, slurred speech, bloodshot and glassy eyes. The defendant failed the nine-step walk and turn and the one-legged stand. - NOT GUILTY Boston Municipal Court - the Trooper responded to an accident on 93 north. The trooper observed an odor of alcohol, slurred speech and unsteadiness. According to the trooper the defendant failed the alphabet and the nine step walk. - NOT GUILTY Concord District Court - The officer stopped the defendant at 1:30 a.m. for a marked lanes violation. The officer noted an odor of alcohol coming from the defendant, slurred speech and bloodshot eyes. According to the officer the defendant said the alphabet with slurred speech and was unsteady on her feet as she stood before him. - NOT GUILTY Fitchburg District Court - The trooper saw the defendant pull out of a night club parking lot and accelerate to 50 mph in a 35 mph. the trooper approached the defendant as he was walking into a store and noted that the defendant appeared unsteady. The trooper also noted that the defendant's speech was slurred and there was an odor of alcohol coming from his person. The defendant had difficulty producing his license and admitted to have 5 or 6 beers earlier in the evening. The defendant failed the one-legged stand, the nine step walk and turn, the alphabet and the finger to nose test.- NOT GUILTY February 2008Plymouth District Court - The officer observed the defendant commit two marked lane violations and then pull improperly into a parking spot. The officer noted an odor of alcohol, bloodshot eyes, slurred speech and unsteadiness. The defendant refused to take all field sobriety tests. - NOT GUILTY January 2008Plymouth District Court - The officer responded to a two car motor vehicle accident. The client had rear-ended another car and was standing outside his vehicle. The officer observed the client to be unsteady on his feet, having a strong odor of alcohol and red and glassy eyes. The defendant stated that he had three beers. According to the officer the defendant failed the alphabet test, the one-legged stand and the nine-step walk and turn..- NOT GUILTY Plymouth District Court - The officer responded to a one car motor vehicle accident. Witnesses stated the client was going to fast and went off the road into a tree. The client was inside the vehicle , semi-conscious and confused. He admitted having a few beers. The officer observed the client to have an odor of alcohol, slurred speech and red and glassy eyes. The defendant stated that he had three beers. The client was transported to the hospital for treatment and later charged.- NOT GUILTY Wareham District Court - The police were notified of a pop up camper and vehicle swerving all over the road. The client stopped and when asked to get out of the car he stumbled and almost fell. The client was on a number of medications and 8 different kinds of pill were found. OUI DRUGS - NOT GUILTY Orleans District Court - The officer saw the client going greater than the speed limit and cross the center line. The officer pulled him over and approached the car. He noted that the client appeared unsteady. He also noted that the defendant's speech was slurred, he had red watery eyes and there was an odor of alcohol coming from his person. The defendant failed the one-legged stand, the nine step walk and turn and the alphabet.- NOT GUILTY |
